General Terms and Conditions of Business and Use (AGB) for the Use of the Platform www.gastarbajter24.de

A. General Provisions

    – hereinafter referred to as the "Platform Operator" –

  2. Definitions
    • Platform: online portal at www.gastarbajter24.de
    • User: any natural or legal person who uses the platform
    • Customer: user who publishes advertisements
    • Member: user with a paid "Platform Friends" membership
    • Visitor: purely informational use without registration
  3. Subject Matter of the Contract

    (1) The Platform Operator provides an online platform for publishing advertisements.

    (2) Use of the platform is generally free of charge.

    (3) In addition, a paid membership ("Platform Friends") can be concluded.

B. Use of the Platform

  1. Registration and User Account

    (1) Registration is required to use certain functions.

    (2) Registration is carried out by providing an e-mail address and a password.

    (3) The user is obliged to provide correct and complete information.

    (4) The contract for the use of the platform (free use) is concluded upon activation of the account.

  2. Free Advertisements

    (1) Creating and publishing advertisements is free of charge.

    (2) There is no entitlement to publication.

    (3) The Platform Operator may review, modify, or remove content at any time.

    (4) A specific availability of the platform is not guaranteed.

C. Paid Membership "Platform Friends"

  1. Description of Services

    (1) Users may voluntarily conclude a paid membership.

    (2) Members are specially highlighted or visibly displayed on the platform.

    (3) The type and scope of presentation are at the discretion of the Platform Operator.

  2. Conclusion of Contract (Paid Services)

    (1) A paid contract is concluded when the user:

    • selects the membership and
    • confirms the registration for the paid membership

    (2) Upon conclusion, the user confirms knowledge of these Terms and Conditions.

  3. Prices and Payment Terms

    (1) The "Platform Friends" membership costs €30.00 per month plus VAT.

    (2) Payment is made, at the user's choice, by:

    • SEPA direct debit
    • bank transfer

    (3) Payment is due monthly in advance.

    (4) In the event of default in payment, the Platform Operator is entitled to suspend services.

  4. Term and Termination

    (1) The membership is concluded for an indefinite period.

    (2) Notice period: 1 month to the end of the month.

    (3) Termination in text form (e.g. e-mail) is sufficient.

    (4) The right to extraordinary termination remains unaffected.

D. Obligations of Users

  1. Prohibited Content

    Users may not publish content that violates applicable law or public morals. In particular, the following are prohibited:

    • criminal content
    • insulting or discriminatory content
    • content infringing copyright
    • pornographic content or content harmful to minors
  2. Responsibility

    (1) Users are themselves responsible for their content.

    (2) The Platform Operator assumes no liability for user content.

  3. Technical Use

    The user undertakes not to take any actions that impair the operation of the platform.

E. Rights of Use

  1. Rights to Content

    (1) The user grants the Platform Operator a non-exclusive right of use to display content.

    (2) This includes in particular the publication and promotion of the content.

F. Liability

  1. Liability of the Platform Operator

    (1) Unlimited liability in cases of intent and gross negligence.

    (2) In cases of slight negligence, only for breach of essential contractual obligations.

    (3) Liability for life, body, and health remains unaffected.

  2. Indemnification

    The user indemnifies the Platform Operator against claims by third parties arising from the user's content.

G. Other Provisions

  1. Blocking of Users

    The Platform Operator may block users or delete content in the event of violations.

  2. Data Protection

    The privacy policy applies, available at: www.gastarbajter24.de/datenschutz

  3. Changes to the Terms and Conditions

    (1) The Platform Operator may amend these Terms and Conditions.

    (2) Users will be informed.

    (3) If the user does not object within 14 days, the changes are deemed accepted.

  4. Right of Withdrawal (for Consumers)

    (1) Consumers are entitled to a statutory right of withdrawal.

    (2) The right of withdrawal may expire prematurely if the service begins immediately and the user consents.

  5. Applicable Law and Place of Jurisdiction

    (1) German law applies.

    (2) The place of jurisdiction is – to the extent permissible – Rüsselsheim am Main.
